StreamIQ – Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the StreamIQ website, software platform, and services (collectively, the “Platform”), operated by StreamIQ [ StreamIQ ], registered in the Republic of South Africa.

By accessing or using StreamIQ, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.


1. Definitions

For purposes of these Terms:

  • “StreamIQ”, “We”, “Us”, “Our” refers to the Platform operator.

  • “School”, “Client”, “Institution” refers to the subscribing educational institution.

  • “User” refers to administrators, staff, parents, or learners granted access by a school.

  • “Services” refers to the school management services provided by StreamIQ.

  • “Subscription” refers to the paid access model selected by the School.


2. Scope of Services

StreamIQ is a Software-as-a-Service (SaaS) platform designed to assist schools with administrative management, academic records, communication, and related functions.

StreamIQ provides the technology infrastructure only. Schools remain fully responsible for:

  • Academic decisions

  • Learner assessments

  • Financial management

  • Compliance with education regulations


3. Account Registration and Authority

By registering for StreamIQ, you confirm that:

  • You are authorised to act on behalf of the School

  • All information provided is accurate and current

  • You will ensure compliance by all Users under your account

Each School is responsible for all activity conducted under its account.


4. Payments, Billing, and Financial Responsibility

4.1 School-to-Parent Payments (Third-Party Gateways)

StreamIQ does not process, collect, hold, or manage payments made by parents or learners to schools.

Schools may independently integrate and use third-party payment gateways, including but not limited to:

  • Stripe

  • Flutterwave

  • Paystack

  • Razorpay

Key clarifications:

  • Schools use their own payment gateway accounts and APIs

  • StreamIQ does not have access to school payment credentials

  • StreamIQ is not a party to parent–school payment transactions

  • All payment disputes between parents and schools are the sole responsibility of the school


4.2 Payments to StreamIQ

Payments collected by StreamIQ are strictly for the Services provided to schools.

These payments may include:

  • Subscription fees

  • Add-on services

  • Customisation or support fees (if applicable)


4.3 Subscription Models

Schools may choose between:

  • Recurring subscriptions (automatically billed monthly or annually), or

  • Manual subscriptions, where payment is made each billing cycle

Schools may:

  • Enable or disable recurring billing at any time

  • Switch to manual monthly payments without penalty

Access to the Platform may be suspended if payment obligations are not met.


5. Refund Policy

5.1 Prepaid Subscriptions

All prepaid subscriptions are non-refundable.

Once a prepaid subscription period has started, no refunds will be issued for:

  • Partial use

  • Early termination

  • Non-usage


5.2 Postpaid (Monthly) Subscriptions

For postpaid subscriptions:

  • Fees are payable for each month services are made available

  • If no issue or dispute is raised before the end of the billing month, the subscription fee remains payable in full

Failure to raise issues timeously constitutes acceptance of the services provided for that period.


5.3 Exceptions

Refunds may only be considered at StreamIQ’s discretion in cases of:

  • Proven system-wide failure

  • Errors directly attributable to StreamIQ

  • Legal or regulatory requirements


6. Intellectual Property

All intellectual property rights in the Platform, including software, content, branding, and documentation, remain the exclusive property of StreamIQ or its licensors.

Schools are granted a limited, non-transferable, non-exclusive license to use the Platform during an active subscription.


7. Data Protection and POPIA Compliance

7.1 Roles Under POPIA

In terms of the Protection of Personal Information Act, 2013 (POPIA):

  • Schools are the Responsible Parties

  • StreamIQ acts as an Operator

StreamIQ processes personal information only on documented instructions from schools.


7.2 Types of Personal Information Processed

This may include:

  • Learner personal and academic data

  • Parent/guardian contact details

  • Staff information

  • System usage and access logs


7.3 Children’s Information

StreamIQ processes children’s information solely for educational purposes as instructed by schools.

Schools are responsible for:

  • Obtaining parental or guardian consent

  • Ensuring lawful processing

StreamIQ applies enhanced security measures to protect learner data.


7.4 Security Measures

StreamIQ implements appropriate technical and organisational safeguards, including:

  • Secure hosting environments

  • Role-based access controls

  • Restricted internal access

  • 2 Factor Authentication
  • Ongoing system monitoring


7.5 Data Retention

Personal information is retained only for as long as necessary to:

  • Provide services

  • Meet contractual and legal obligations

Data is securely deleted or anonymised thereafter.


8. Parent and Learner Usage Terms (Incorporated)

Parents and learners access StreamIQ through their school and agree to the following:

  • Use the Platform only for school-related purposes

  • Keep login credentials confidential

  • Act respectfully and lawfully

  • Not misuse communication tools or access unauthorised data

Parents acknowledge that:

  • The school controls data and content

  • StreamIQ does not determine academic outcomes

  • Requests regarding learner data must be directed to the school

Learners must comply with school codes of conduct when using the Platform.


9. Acceptable Use and Restrictions

Users must not:

  • Attempt to bypass security

  • Upload unlawful, offensive, or misleading content

  • Interfere with system performance

  • Reverse engineer or copy the Platform

StreamIQ may suspend or terminate access for violations.


10. Availability and Service Limitations

While StreamIQ aims for high availability:

  • Downtime may occur due to maintenance or external factors

  • Features may vary based on subscription level

Services are provided “as is” and “as available.”


11. Limitation of Liability

To the fullest extent permitted by South African law:

  • StreamIQ is not liable for indirect or consequential damages

  • StreamIQ is not responsible for decisions made by schools

  • StreamIQ is not liable for data errors supplied by schools


12. Indemnification

Schools agree to indemnify StreamIQ against claims arising from:

  • Unlawful data processing

  • Failure to obtain required consent

  • Misuse of the Platform

  • Payment disputes with parents or third parties


13. Amendments

StreamIQ may amend these Terms from time to time. Continued use of the Platform constitutes acceptance of updated Terms.


14. Governing Law

These Terms are governed by the laws of the Republic of South Africa. South African courts have exclusive jurisdiction.
